Senator Elizabeth Warren has issued a public plea to Elon Musk, asking him to recommend the cessation of federal marijuana enforcement in states where cannabis markets are regulated. This unusual appeal comes as Musk co-leads the Department of Government Efficiency (DOGE), tasked with slashing up to $2 trillion in federal spending.

The request, outlined in a January 23 letter, highlights the cost-saving potential of deprioritizing marijuana-related federal actions in regulated states, a move Warren says could save hundreds of millions of dollars annually.

A Cost-Cutting Opportunity for DOGE

Musk’s role at the helm of DOGE places him at the forefront of budgetary decisions. Appointed by President Donald Trump to co-lead the initiative alongside entrepreneur Vivek Ramaswamy—who has since stepped down to explore a gubernatorial bid in Ohio—Musk has been tasked with identifying inefficiencies in government spending.

Warren’s letter positions federal marijuana enforcement as an area ripe for cuts. The Massachusetts senator argues that federal arrests for marijuana possession make up about 25% of all drug possession arrests. Despite these numbers, actual federal sentences for marijuana-related offenses remain rare.

“Federal arrests and seizures targeting marijuana activity in regulated states waste valuable resources,” Warren stated. She pointed to federal agencies, such as Homeland Security and Customs and Border Protection, as culprits in high-cost seizures of state-regulated cannabis products.

Real-World Example: New Mexico Checkpoints

Warren specifically highlighted federal actions in New Mexico, where agencies have seized marijuana at internal checkpoints, even when the product was legal under state law. These incidents, she argued, are emblematic of broader inefficiencies in how federal resources are allocated.

“DOGE should recommend that the U.S. Departments of Justice and Homeland Security prioritize their resources more effectively,” Warren wrote. “This includes ending costly arrests and enforcement actions against marijuana activities that are legal in the jurisdiction where they occur.”

Federal Reform: A Long-Held Dream

Many advocates see Trump’s second term as a potential turning point for federal marijuana reform, despite past disappointments. Hopes for change were briefly buoyed by Trump’s support for a failed marijuana legalization effort in Florida, but progress has been limited.

For Warren and other reform proponents, the issue is not just about cutting costs but also about fairness and consistency in federal policy. The senator’s push aligns with growing public support for marijuana legalization, which has reached record highs in recent years.

Musk’s Marijuana Moment

Elon Musk has not publicly taken a stance on marijuana policy, though he famously smoked cannabis during a 2018 interview with Joe Rogan. That incident drew widespread attention but did little to clarify Musk’s views on the broader legalization debate.

Warren’s letter noted that Musk previously ignored her December outreach on the subject. It remains unclear whether the billionaire entrepreneur will respond to this latest request.

What’s at Stake?

Warren’s argument is straightforward: reallocating federal resources away from marijuana enforcement could save money and reduce unnecessary detentions. This approach also aligns with the broader push for criminal justice reform and the decriminalization of cannabis at the federal level.

The savings could be significant:

  • Federal marijuana arrests: Account for about one-quarter of all drug possession arrests, according to Warren.
  • Enforcement costs: Run into hundreds of millions annually, covering everything from arrests to detentions and legal proceedings.
  • Public opinion: Reflects overwhelming support for marijuana legalization, with over two-thirds of Americans favoring reform, according to recent polls.

The Road Ahead

Whether Musk will take up Warren’s suggestion remains uncertain. With his focus on high-profile projects and cost-saving measures, the issue of marijuana enforcement could fall by the wayside. However, the growing momentum for reform—and the undeniable fiscal argument—could make this a harder issue to ignore.

Observers are watching closely to see if DOGE, under Musk’s leadership, addresses this pressing issue. For now, Warren’s letter has spotlighted a policy gap that costs taxpayers millions while undermining the intent of state-level cannabis regulations.
